New MCA Code of Practice for Small Commercial Vessels

From鈥12 December 2025, the UK Maritime & Coastguard Agency (MCA) will introduce鈥, a major regulatory update that鈥痗onsolidates鈥痯revious鈥痝uidance into a single, modern framework.  

This is the most鈥痵ignificant change鈥痠n over 20 years, and operators of coded vessels should start preparing now.鈥

What鈥檚 changing?鈥

The new Code:鈥

  • Replaces鈥痶he Blue, Yellow, and Red Codes,鈥疢GN 280, and the Intended Pleasure Vessels Code, creating鈥痮ne unified standard听
  • Reflects advances in鈥痸essel design,鈥痯ropulsion technology, and鈥痵afety practices, while supporting environmental goals such as鈥痙ecarbonisation鈥
  • Introduces clearer requirements for鈥痵urvey, inspection, and certification, and provisions for鈥痑lternative fuels and hybrid/electric propulsion鈥

Who does it apply to?鈥

  • Small vessels under 24m鈥痠n鈥痗ommercial use for sport or pleasure, carrying鈥痭o more than 12 passengers.鈥
  • Vessels meeting the definition of a鈥痯leasure vessel鈥痳emain outside the scope and鈥痙o not need to comply听
  • Vessels operated by 911制品Recognised Training Centres in accordance with the RGNs for dinghy, keelboat, multihull, powerboat and personal watercraft centres where training is delivered up to three miles out to sea in daylight hours only do not need to comply. 911制品recognition is an alternative to Category 6 of the Code of Practice for Small Commercial Vessels.听
  • RTCs offering the Yachtmaster scheme, Advanced Powerboat or Tender Operator courses should have commercially certified vessels. RTCs offering the Powerboat Intermediate course may also require commercially certified vessels.听

Key legal definition鈥

Under the鈥,鈥鈥減leasure vessel鈥 means鈥撯

any vessel which at the time it is being used is鈥斺

i. in the case of a vessel wholly owned by鈥斺

(aa) an individual or individuals, used only for the sport or pleasure of the owner or the immediate family or friends of the owner; or鈥

(bb) a body corporate, used only for sport or pleasure and on which the persons on board are employees or officers of the body corporate, or their immediate family or friends; and鈥

on a voyage or excursion which is one for which the owner does not receive money for or in connection with鈥痮perating鈥痶he vessel or carrying any person, other than as a contribution to the direct expenses of the operation of the vessel incurred during the voyage or excursion; or鈥

any vessel wholly owned by or on behalf of a members鈥 club formed for the purpose of sport or pleasure which, at the time it is being used, is used only for the sport or pleasure of members of that club or their immediate family, and for the use of which any charges levied are paid into club funds and applied for the general use of the club,鈥

where, in the case of any vessel referred to in paragraph (a) or (b), no other payments are made by or on behalf of users of the vessel, other than by the owner; and in this definition 鈥渋mmediate family鈥 means, in relation to an individual, the spouse or civil partner of the individual, and a relative of the individual or the individual鈥檚 spouse or civil partner; and 鈥渞elative鈥 means brother, sister, ancestor or lineal descendant;鈥

  • In simple terms:鈥
    If payment for a vessel owned by an individual or company is being made for use of the vessel beyond a contribution to the direct costs of the specific voyage (i.e. fuel, food and berthing costs can be covered but not general maintenance or upkeep costs) then the vessel is not a pleasure vessel and is subject to the regulations for commercial vessels. 听
  • If the vessel is owned by a sailing club, then the club can charge for use of the vessel. It is important however to fully consider all the requirements of the pleasure vessel definition as payment is not the only factor.鈥

The definition of a鈥痯leasure vessel鈥痙epends on ownership type:鈥 

  • Individual owner鈥
  • Body corporate鈥(e.g a legal entity such as a charity or a company)鈥
  • Members鈥 club鈥痜ormed for sport or pleasure (e.g. a sailing club)鈥

The distinction is important:鈥

  • For鈥痓ody corporates, the definition places specific requirements on鈥痺ho is onboard.鈥
  • For鈥痠ndividuals and clubs, the requirement is that the vessel is being used for the鈥痵port or pleasure of the owner or members, not that they are physically onboard.鈥

  • A club launch driven by a club employee (not a member) is still a pleasure vessel if used for members鈥 sport or pleasure.鈥
  • A member lending their personal RIB to lay marks for an event while they race is also a pleasure vessel, as the use supports the owner鈥檚 sport.鈥
  • A charity which takes members of the public out for a sail on a vessel it owns, is a commercial vessel as it is owned by a body corporate and the persons onboard are not limited to employees or officers.听

Race Support Boats鈥

The new Code introduces a dedicated section for鈥疪ace Support Boats, replacing Part 2 of the Intended Pleasure Vessel (IPV) Code. This applies to vessels that, when used for race support, fall under the definition of a鈥痗ommercial vessel.鈥

What is a Race Support Boat?鈥 A vessel used for a race organised by an鈥疪YA-affiliated Organising Authority (OA)鈥痜or:鈥

  • Mark laying鈥
  • Safety or patrol cover鈥
  • 颁辞补肠丑颈苍驳鈥
  • Judging or umpiring鈥
  • Other activities directly supporting competitors鈥

Key points:鈥

Vessels that meet the鈥痯leasure vessel definition鈥(e.g. club patrol RIBs, committee boats) do鈥痭ot鈥痭eed to鈥痗omply with鈥痶his section.鈥

Section鈥27B鈥痑llows non-coded vessels to鈥痮perate鈥痑s race support boats if they meet simple requirements in鈥27B.2.鈥

Requirements for Race Support Boats鈥

  • The OA must have a鈥疭afety Management System鈥(aligned with 911制品affiliation recommendations).鈥
  • If the vessel has a鈥疌E plate鈥痮r鈥疷KCA plate, many requirements can be disregarded as it鈥痗omplies with鈥疪ecreational Craft Regulations.鈥

OA must ensure the vessel鈥檚鈥痙esign category鈥痵uits expected conditions. The OA needs to satisfy itself that the design category of the vessel is suitable for the鈥痩ikely conditions鈥痠t may be expected to鈥痮perate鈥痠n.鈥

A CE-plated vessel meeting鈥911制品Training Centre coastal requirements鈥痲ualifies with:鈥

  • Two thermal protective aids鈥(instead of one)鈥
  • Two throwing lines鈥(minimum length 18m each)鈥

Key changes from IPV Code鈥

  • Payment鈥痜or race support boats is now鈥痯ermitted.鈥
  • Night operations鈥痑llowed if full manning requirements are met (e.g., Advanced Powerboat Commercially Endorsed).鈥
  • RYA鈥痠s required to鈥痠ssue a certificate confirming OA affiliation and race legitimacy.鈥
    No charge鈥痺ill be made鈥痜or affiliates鈥痺ith the鈥痯rocess鈥痓eing鈥痑vailable via the 911制品Portal.鈥
